Janhvi Kapoor Case Takes a Major Turn: Court Clarifies Limits of Personality Rights

Actress Janhvi Kapoor has approached the Delhi High Court seeking protection against obscene and pornographic content allegedly being circulated online using her name, photographs and likeness. The case has now highlighted an important question surrounding celebrity personality rights and the limits of online expression.

The Delhi High Court directed the removal of certain objectionable content allegedly misusing Janhvi Kapoor’s identity. However, the court stopped short of granting a blanket order that would restrict every use of the actress’s name, image or likeness across the internet.

Justice Bhambhani observed that merely using a celebrity’s name, photograph or likeness does not automatically constitute an infringement of personality rights. The court also indicated that legitimate forms of expression, including fan activity, admiration, criticism, commentary and satire, cannot be broadly prohibited simply because they involve a celebrity’s identity.

The court emphasised that personality rights cannot become a means to silence lawful speech or public expression. At the same time, it recognised the need to protect Janhvi Kapoor from obscene and pornographic material allegedly being presented or circulated in her name.

The order therefore draws a clear distinction between unlawful and objectionable content and legitimate public expression involving a celebrity. The case could also become significant in shaping how Indian courts approach personality rights in the digital era.

Janhvi Kapoor’s Upcoming Projects

On the work front, Janhvi Kapoor has not officially announced her next Telugu film. However, she is rumoured to be part of Allu Arjun’s upcoming project Raaka. She is also reportedly in talks for a Bollywood love story that could feature her alongside Sreeleela.
