Recently, U.S. President Donald Trump made headlines by declaring a policy to impose a 100% tariff on all foreign films released in the United States. This decision has triggered widespread debates across the global film industry—especially in India, where a significant share of film exports reach American audiences.
Under this new rule, every foreign movie—including all Indian films—would face blockbuster-level taxes before they could be screened in the U.S. Naturally, this move has worried many in Tollywood and beyond, who see the American market as a crucial revenue source.
However, Telugu actor Nikhil Siddhartha has come forward to calm the film fraternity’s concerns. In a candid social media post, Nikhil explained that putting such tariffs into action is, in fact, legally impossible due to multiple protections enshrined in U.S. law and international agreements.
What the Law Really Says
Nikhil pointed out that the Berman Amendment (50 U.S.C. §1702(b)(3)) of American law specifically blocks the President from imposing tariffs on the import of informational materials—including films—using emergency powers. Congressional records reinforce that foreign cultural products like movies enjoy special legal status and protection from such tariffs.
Beyond American law, Nikhil also mentioned that the U.S. Constitution’s First Amendment protects free speech, which includes films as an art form. Additionally, World Trade Organization (WTO) agreements make it extremely difficult for any country to erect such barriers without facing global legal backlash.
Courts Have Blocked Similar Moves Before
Nikhil reminded everyone that in recent years, U.S. courts have already set aside attempts to impose tariffs on informational and cultural imports using the same authority, declaring such attempts unenforceable.

While there’s palpable anxiety in the industry, Nikhil’s clarification offers hope. For now, Tollywood can look at these legal safeguards as a shield against sudden changes in U.S. policy.
